These Terms of Service (“Terms”) govern your access to and use of pekindispensary.com (the “Site”), operated by Miggy’s Shop, LLC d/b/a Pekin’s Local Dispensary & Supply (“we,” “us,” “our”) at 359 Court St., Pekin, Illinois 61554. By accessing the Site or placing an order through the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. You Must Be 21 or Older

The Site is intended only for adults aged 21 years or older. Adult-use cannabis is regulated by the State of Illinois under the Cannabis Regulation and Tax Act (410 ILCS 705) and is available only to adults aged 21 and over presenting valid government-issued photo identification. By using the Site or placing an order, you represent that you are at least 21 years old, are physically located in Illinois, and will present valid ID at pickup or delivery.

2. About This Site

We are an Adult Use Dispensing Organization licensed by the Illinois Department of Financial and Professional Regulation, License No. 284.000371-AUDO (expires 03/31/2028). The Site is informational and provides an embedded ordering experience powered by Dutchie. All transactions occur in person at our dispensary at 359 Court St., Pekin, Illinois, or through approved delivery channels where available.

3. Account and Order Information

If you create an account or place an order, you agree to provide accurate, current, and complete information and to keep your account credentials confidential. You are responsible for activity under your account. Orders are not confirmed until reviewed and processed by our staff. We reserve the right to refuse or cancel any order, including for failure to verify age, suspected fraud, or product unavailability.

4. No Returns on Cannabis

Under Illinois law, cannabis and cannabis-infused products may not be returned or exchanged once they leave the dispensary. We may, in our sole discretion, replace defective products or correct order errors at the time of pickup before the customer leaves the premises. Non-cannabis merchandise (accessories, apparel) follows the return policy posted in-store.

5. Pricing, Taxes, and Availability

All prices are in U.S. dollars and exclude applicable Illinois state and local sales taxes and Illinois cannabis purchaser excise taxes, which are added at checkout based on product type and Illinois law. Prices and product availability may change without notice. Discounts (veteran, senior, first-time buyer, birthday, etc.) are subject to verification at pickup and may not be combined unless expressly permitted.

6. Acceptable Use

When using the Site, you agree NOT to:

  • Use the Site if you are under 21
  • Provide false or misleading information
  • Place orders on behalf of any person under 21 or for resale
  • Transport cannabis purchased here outside the State of Illinois (federal law prohibits the interstate transport of cannabis)
  • Consume cannabis on dispensary premises or in any public place where prohibited by Illinois law
  • Operate a vehicle, watercraft, or aircraft while impaired
  • Use the Site to scrape, mirror, or harvest data, or to interfere with normal operation
  • Misrepresent your identity, age, or location
  • Use the Site for any unlawful purpose

7. Important Cannabis Warnings

  • Cannabis is intended for use only by adults 21 and older. Keep out of reach of children, pets, and unauthorized persons.
  • Cannabis remains illegal under federal law. Use at your own risk.
  • Do not drive or operate machinery after consuming cannabis.
  • Cannabis may impair concentration, coordination, and judgment. Effects vary by product and individual.
  • If you are pregnant or nursing, consult a healthcare provider before using cannabis.
  • Cannabis purchased here is for personal, lawful use within Illinois only. Do not transport across state lines.

8. Intellectual Property

All content on the Site — including text, graphics, logos, images, and the Pekin’s Local Dispensary & Supply name and marks — is owned by Miggy’s Shop, LLC or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent, except for personal, non-commercial use.

9. Third-Party Services

The Site uses third-party services to operate, including Dutchie (eCommerce, point-of-sale, loyalty, and marketing), Cloudflare (network and security), and Mailgun (email delivery). These providers process certain information on our behalf. See our Privacy Policy for details on how your information is handled.

The Site may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of those sites.

10. Disclaimers

The Site and all content are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Nothing on the Site constitutes medical, legal, or professional advice. Information about cannabis products is not intended to diagnose, treat, cure, or prevent any disease or condition. Consult your healthcare provider with questions about cannabis use.

11. Limitation of Liability

To the maximum extent permitted by Illinois law, Miggy’s Shop, LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising out of or relating to your use of the Site or any product purchased through it. Our total liability for any claim relating to the Site or products purchased through it will not exceed the amount you paid to us in the three (3) months preceding the claim.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Miggy’s Shop, LLC from any claim, loss, or expense (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws principles. Any dispute relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Tazewell County, Illinois, and you consent to personal jurisdiction there. Nothing in this section limits your right to bring a claim in small claims court if otherwise eligible.

14. Modifications

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last Updated” date. Material changes will be highlighted on the Site or communicated by email if you have provided one. Continued use of the Site after changes take effect constitutes acceptance.

15. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
