This Privacy Policy explains how Miggy’s Shop, LLC d/b/a Pekin’s Local Dispensary & Supply (“we,” “us,” “our”) collects, uses, shares, and protects information when you visit pekindispensary.com (the “Site”), shop with us in-store, or order online through our Dutchie-powered storefront. By using the Site, you agree to the practices described here.

2. No Use of the Site by Persons Under 21

The Site is intended only for adults aged 21 years or older. Use of the Site by anyone under 21 is strictly prohibited. Personal information submitted by a person under 21 will not knowingly be accepted, and any such information that comes to our attention will be deleted.

3. Information We Collect

Identification and contact information — name, date of birth, address, email, phone number — collected when you sign up for our loyalty program, place an order, or contact us.

Government ID information — we scan a valid government-issued photo ID at the door to verify you are 21 or older. The barcode on the back of your ID contains your name, address, date of birth, and license number. We retain this information only as required by Illinois law and to operate the dispensary.

Transaction information — items purchased, quantities, prices, payment method (cash, debit, Pay-by-Bank ACH), receipt details, and loyalty points earned and redeemed.

Communications information — the content of messages you send us, your subscription preferences, opt-in/opt-out status, and SMS/email engagement (delivery, opens, clicks).

Online and technical information — IP address, device and browser type, referring URL, pages visited, and similar data collected automatically when you visit the Site, primarily to operate, secure, and improve the Site.

Cookies and similar technologies — see Section 10 below.

Biometric information — we do not currently collect biometric identifiers (fingerprints, face geometry, retina/iris scans, voiceprints) regulated under the Illinois Biometric Information Privacy Act (BIPA), 740 ILCS 14. If we ever introduce a service that captures biometric identifiers, we will provide notice and obtain written consent in accordance with BIPA before doing so.

4. How We Use Your Information

• To verify your age and identity at entry and at the point of sale, as required by Illinois law
• To process and fulfill your orders, including reviewing and packaging products
• To operate our loyalty program and apply discounts you are eligible for
• To send you order confirmations, pickup/ready notifications, receipts, and account communications
• To send you marketing messages (email, SMS, push) only with your consent — you can opt out at any time
• To improve the Site, our products, and our services
• To prevent fraud, theft, and unauthorized access
• To comply with Illinois and federal law, including reporting to the Illinois Department of Financial and Professional Regulation (IDFPR), the Illinois Department of Revenue, and the Illinois cannabis state-tracking system (Metrc), and to respond to lawful requests by law enforcement

5. How We Share Information

We do not sell your personal information to third parties. We share information only as needed to operate.

Service providers (sub-processors) that operate parts of our business under contract:

• Dutchie — point-of-sale, eCommerce storefront, loyalty and marketing platform, mobile app builder. Dutchie processes order, customer, and loyalty data on our behalf.
• Cloudflare — content delivery, security, and email routing for pekindispensary.com.
• Mailgun — email delivery for transactional and marketing emails sent from this domain.
• Pay-by-Bank / ACH processors — handles ACH payment authorization. We do not store full bank account numbers ourselves.

Illinois state systems — Metrc (Illinois cannabis state-tracking system), the Illinois Department of Revenue, and IDFPR, as required by law.

Law enforcement, regulators, and the courts — when required by subpoena, court order, or applicable law (see Section 6 regarding federal cannabis legal status).

Professional advisors — accountants, auditors, and attorneys, under confidentiality.

Successor entities — in the event of a sale, merger, or reorganization, your information may be transferred to the successor entity, subject to this Policy.

6. Federal Cannabis Status and Information Requests

Cannabis remains illegal under federal law (Controlled Substances Act, 21 U.S.C. § 801 et seq.), even though Illinois has legalized adult-use cannabis under state law. As a state-licensed cannabis dispensary, there is a possibility that we may receive an information request from a federal agency that includes the personal information of our customers. We will seek the advice of legal counsel about the legitimacy of any such request and assert all available legal protections, but we cannot guarantee that your information will not be disclosed in response to a lawful federal request.

7. How We Protect Your Information

We use reasonable administrative, technical, and physical safeguards to protect your information, consistent with the Illinois Personal Information Protection Act (PIPA), 815 ILCS 530, and other applicable laws. Sensitive information transmitted through the Site is encrypted in transit using TLS. No system is perfectly secure.

Breach notification. In line with Fair Information Practice Principles, if a data breach affecting your personal information occurs, we will notify you by email within seven (7) business days of confirmation, or sooner where required by Illinois law.

8. How Long We Keep Information

We retain personal information only as long as needed for the purposes described in this Policy, or as required by Illinois cannabis recordkeeping rules and tax law (which generally require us to retain dispensary transaction and customer records for at least five (5) years). Marketing data is retained for as long as you remain subscribed plus a reasonable period for unsubscribe handling. Account information is retained for the life of your account and a reasonable period thereafter for our recordkeeping obligations.

9. Your Rights and Choices

You may:

• Request a copy of personal information we hold about you
• Correct inaccurate information
• Delete information, subject to our recordkeeping obligations under Illinois cannabis law and tax law
• Withdraw consent for marketing communications at any time
• Opt out of SMS by replying STOP to any text message; reply HELP for help
• Opt out of email by clicking the unsubscribe link in any marketing email

To exercise these rights, contact us at hello@pekindispensary.com or (309) 444-6108. We will respond within a reasonable time (generally within 30 days). We may need to verify your identity before fulfilling your request.

10. Cookies and Similar Technologies

The Site uses cookies and similar technologies for:

• Strictly necessary — to operate the age gate, hold your cart, secure the Site (Cloudflare), and manage your session
• Functional — to remember your preferences (language, recent products)
• Analytics — to understand how the Site is used (e.g., page views, popular products)
• Marketing — only if you opt in; to measure advertising effectiveness

Our consent banner allows you to manage your cookie preferences. You can also block or delete cookies through your browser settings. Blocking strictly necessary cookies may break Site functionality.

11. Marketing — Email, SMS, and Push

We send marketing messages only with your consent.

Email (CAN-SPAM Act, 15 U.S.C. § 7701 et seq.). We collect your email address to send order confirmations, opening or operational updates, and (with your separate consent) marketing messages. To comply with CAN-SPAM, we agree to:

• Not use false or misleading subject lines or sender addresses
• Identify marketing emails as advertising in a reasonable way
• Include our physical business address in every marketing email
• Honor opt-out requests promptly
• Provide an unsubscribe link in every marketing email

SMS / MMS (Telephone Consumer Protection Act, 47 U.S.C. § 227). SMS marketing requires your express written opt-in. Consent is not a condition of any purchase. Message and data rates may apply. Reply STOP to any message to opt out, or HELP for help. Frequency varies; up to a few messages per week.

Your mobile opt-in is never shared. No mobile information — including your phone number and SMS consent — will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties. We share this information only with the subcontractors that operate our messaging program on our behalf (such as our SMS delivery provider and customer-service tools), strictly to deliver the messages you request.

Push notifications. Sent only after you install our mobile app and grant push permission in your device settings. You can disable push notifications at any time in your device settings.

We do not sell or rent your contact information to third-party marketers.

12. Children’s Privacy (COPPA)

The Site is not directed at children under 13 and is not directed at anyone under 21. We do not knowingly collect personal information from children under 13 in violation of the federal Children’s Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506. If you believe we have collected information from a child under 13, contact us immediately and we will delete it.

13. Out-of-State Visitors and Cannabis Restrictions

Cannabis purchased from us may not be transported across Illinois state lines (federal law). The Site is intended for residents and visitors physically located in Illinois who are 21 or older. We make no representation that the Site or any product is appropriate or available for use in any other jurisdiction.

14. Third-Party Links

The Site may contain links to third-party websites or services. We are not responsible for the content, accuracy, or privacy practices of those sites. Your interactions with third-party sites are governed by their own policies.

15. Changes to This Policy

We may update this Policy from time to time. The updated version will be posted on this page with a new “Last Updated” date. Material changes will be highlighted on the Site or communicated by email if you have provided one. Continued use of the Site after changes take effect constitutes acceptance.
